Terms of Service of the online store perfumify.eu


§1. General provisions


 1. The online store operating at perfumify.eu (the “Store”) is run by Piotr Górecki, ul. Zgodna 97, 30-444 Libertów, Poland, (the “Seller”).

 2. Contact: franekfryz@gmail.com.

 3. These Terms set out the rules for concluding contracts for the supply of digital content through the Store.


§2. Definitions

Consumer — a natural person concluding a contract not directly related to their business or professional activity, as well as a sole trader treated as a consumer (Article 38a of the Act on Consumer Rights).

Digital content / Product — the electronic product offered in the Store, in particular a file containing the contact details of a perfume supplier, delivered electronically.


§3. Technical requirements

To use the Store and receive the Product, you need: a device with internet access, an up-to-date browser, an active email address, and software capable of opening the file in the format in which the Product is delivered (e.g., PDF).


§4. Conclusion of the contract


 1. The Customer places an order by adding the Product to the cart, providing their data, and selecting a payment method.

 2. Placing an order requires acceptance of these Terms and — in the case of immediate delivery of digital content — ticking the statement referred to in §7.

 3. The contract is concluded when the Seller confirms acceptance of the order to the Customer’s email address.


§5. Prices and payments


 1. All prices displayed in the Store are gross prices (inclusive of applicable taxes).

 2. Payment is made in advance via the payment methods available in the Store.

 3. The sales document is provided electronically.


§6. Delivery of the Product


 1. The Product is delivered exclusively electronically — by sending the file or a download link to the email address provided in the order.

 2. Delivery takes place promptly after payment is credited, no later than within 24 hours.

 3. The Store does not provide physical shipping.


§7. Right of withdrawal


 1. A Consumer has the right to withdraw from the contract within 14 days without giving a reason (Article 27 of the Act on Consumer Rights).

 2. The right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium where the Seller has begun performance with the Consumer’s prior and express consent, the Consumer having been informed before performance began that they would lose the right of withdrawal and having acknowledged this, and the Seller has provided confirmation of the conclusion of the contract (Article 38(13) of the Act on Consumer Rights).

 3. When placing an order with immediate delivery, the Consumer ticks the statement: “I consent to the supply of the digital content before the expiry of the withdrawal period and acknowledge that I lose the right of withdrawal once delivery begins.”

 4. Withdrawal (where applicable) is made by sending a statement to franekfryz@gmail.com. The price is refunded within 14 days using the same payment method.


§8. Complaints (conformity of digital content with the contract)


 1. The Seller is obliged to deliver a Product that conforms to the contract.

 2. Where the Product does not conform to the contract, the Consumer has the rights set out in Chapter 5b of the Act on Consumer Rights (including bringing the content into conformity and, in certain cases, a price reduction or withdrawal and refund).

Complaints should be submitted to franekfryz@gmail.com, stating the order details and a description of the issue. The Seller will consider the complaint within 14 days.


§9. Out-of-court dispute resolution

A Consumer may use out-of-court methods of handling complaints and pursuing claims, including the district (municipal) consumer ombudsman or the Provincial Inspectorate of the Trade Inspection. Information is available on the website of the Polish Office of Competition and Consumer Protection (UOKiK, uokik.gov.pl).


§10. Personal data

The processing of personal data is governed by the Privacy Policy available in the Store.


§11. Final provisions


 1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code and the Act on Consumer Rights.

 2. These Terms enter into force upon publication in the Store and may be amended; orders are governed by the Terms in force at the time the contract is concluded....
